So....I came upon a situation that's happened plenty of times in my days wheeling....

I think I have the right answer, but I'd like your opinon...

When on a narrow trail on a slope/incline...and you and another vehicle come face to face...

Who has the right of way?  It happened to me Sunday....a guy in a stock Acura mall crawler stopped....then pulled over with his ass end sticking out too far, which would have meant my drivers side would have potentially been off the trail...and down the cliff

So, I politely asked him to back up a little to a turnout about 50ft behind him...

He barely spoke english and muttered "Can you....."

I looked at him dead in the eye and said "Sir, I need you to back up about 50ft and there will be plenty of room for me to pass"

Regardless of my story....

who has the right of way in a situation like that?  I think I did, coming up the hill.

Alas...I've been wrong before....

I've always heard and practiced that uphill vehicles have the right of way.

Yes you are correct.  The one who can back up the hill should be the one doing this.  As it is more dangerous to back down the hill where the momentum is going.

If you could of done it more safely than him though it should of been you.

So from what I have always seen is whoever can do the action more safely is primary.  If both are about the same the person who can back up the hill should be doing it.  As backing up the hill is more safe than backing down the hill.

I certainly had the more capable rig, but I was on a narrow stretch of trail, on a decent incline and there was a 45deg turn about 50ft behind him....and those turns always have extra room....

the vehicle going uphill has the right of way.  However, if the road is level, the bigger one can always push the smaller one around.  Size does matter.  Just saying...

You would think I was drunk if you saw me backing down a curving, twisting, narrow shelf road with the mountain on one side and a sheer dropoff on the other side.  I end up trying to hug the mountain too much.
